After being denied benefits under her employers Severance Plan for Selected Employees ("Plan"), Judy Dabertin brought an action under the Employee Retirement Income Security Act ("ERISA"), 29 U.S.C. §§ 1001 et seq. against her employer HCR Manor Care ("HCR"), the Plan, and the Plans administrator and the committee appointed by HCRs Board of Directors to administer the Plan ("Committee") seeking district court review of the Committees determination. The district court held that the Committee was arbitrary and capricious in denying Dabertins claim for severance benefits. We affirm in all aspects save for one minor housekeeping matter which we remand for further consideration.
